We hereby inform you that this website https://tropemc.org/ and the Trope MC mobile application (hereinafter, jointly, the “Website”) are owned and operated by Trope MC LLC (hereinafter, “Trope MC”), with EIN number 32-0780450 and registered office at 1209 Mountain Road PL NE STE N, Albuquerque, New Mexico 87110, United States.

Access to and/or use of the Website confers the status of user and implies acceptance, from such access and/or use, of this Legal Notice.

2. Website User

The User assumes responsibility for the use of the Website. The Website may provide access to a multitude of texts, graphics, drawings, designs, photographs, multimedia content and information (hereinafter, “Content”) belonging to Trope MC or to third parties to which the User may have access.

The User must make appropriate use of the Content and services offered through the Website and, by way of example but without limitation, must not use them to:

  • Engage in activities that are illicit, illegal, or contrary to good faith and public order.
  • Cause damage to the physical and logical systems of the Website, its suppliers, or third parties.
  • Introduce or disseminate computer viruses or any other physical or logical systems liable to cause the damage described above.
  • Attempt to access, use, and/or manipulate the data of Trope MC, third-party collaborating entities, and other users.
  • Reproduce, copy, distribute, allow public access to, transform, or modify the Content, unless authorized by Trope MC.
  • Delete, conceal, or manipulate Content subject to intellectual or industrial property rights or other identifying data included in the Content, or any technical protection or information mechanisms inserted therein.

Trope MC reserves the right to investigate and report any of the above conduct in accordance with applicable law, and to cooperate with the relevant authorities in investigating such actions.

Trope MC may temporarily suspend, without prior notice, access to the Website for maintenance, repair, updating, or improvement operations. Whenever circumstances permit, Trope MC will inform the User sufficiently in advance of the planned suspension. Trope MC is not responsible for the use Users may make of the Content included on the Website.

3. Intellectual and Industrial Property

All intellectual property rights over the content and graphic design of the Website (including, but not limited to, images, sound, audio, video, software, texts, trademarks, logos, colour combinations, structure and design, selection of materials used, and computer programs necessary for its operation, access, and use) are the exclusive property of Trope MC or of a third party that has authorized its use. Trope MC therefore holds the exclusive right to exploit such content and graphic design.

The reproduction, transmission, adaptation, translation, distribution, or public communication — including making available or any other form of commercial exploitation and/or modification of all or part of the content of the Website — is expressly prohibited unless prior and express authorization has been given by Trope MC.

Trope MC does not grant any licence or authorization to use any of its intellectual and industrial property rights, or any other right related to the Website and/or its services or content.

The User undertakes to respect the intellectual and industrial property rights owned by Trope MC. Reproduction and temporary storage of the Website’s content is permitted only insofar as strictly necessary for the use and display of the Website from a computer, tablet, or mobile device.

The legitimacy of intellectual or industrial property rights over content provided by Users is the exclusive responsibility of the Users themselves, who shall be liable for any third-party claim arising from unlawful use of the Website’s content. Designs, logos, texts, and/or graphics that do not belong to Trope MC and that may appear on the Website belong to their respective owners, who are responsible for any controversy that may arise with respect to them.

4. Data Protection

Use of this Website may require Users to provide personal data. Trope MC processes this information in accordance with applicable legislation, as set out in its Privacy Policy.

5. Liability and Guarantees

Trope MC declares that it has adopted all necessary measures, within its possibilities and taking into account the current state of technology, to allow the correct functioning of the Website and the absence of viruses and harmful components. However, Trope MC cannot guarantee:

  • The continuity and availability of the Content and Services at all times;
  • The absence of errors in such Content or the correction of any defects that may exist;
  • The truthfulness, completeness, or timeliness of data provided by Users, who are ultimately responsible for providing accurate and up-to-date information;
  • Uninterrupted operation of the Website, or the absence of computer failures, telephone breakdowns, disconnections, delays, or blockages caused by deficiencies or overloads in telephone lines, data centres, the Internet, or other electronic systems; or
  • The absence of damage caused by third parties who violate or breach Trope MC’s security systems, although Trope MC will take appropriate measures to prevent this.

6. Duration and Modification

This Legal Notice shall remain in force indefinitely. Trope MC may modify the conditions set out herein at any time, with such changes taking effect from the moment of their publication. Trope MC may remove, add, or modify the Content and services it provides, as well as the manner in which they are presented. Access to and/or use of the Website after any such modification constitutes acceptance by the User of the amended Legal Notice.

7. Hyperlinks

Trope MC assumes no responsibility for links to other applications or websites found on the Website, which may direct the User to third-party applications or websites over which Trope MC has no control, and is not responsible for the information contained therein. The inclusion of such links does not imply approval of their content by Trope MC nor the existence of any association between Trope MC and the owners of those websites or applications. Users access third-party Content under their sole responsibility and subject to the terms of use that govern it.

8. Safeguarding and Interpretation

This Legal Notice constitutes an agreement between each User and Trope MC. If a competent authority declares any provision illegal, invalid, or unenforceable, that declaration shall not affect the validity of the remaining provisions. The fact that Trope MC does not require strict compliance with any provision of this Legal Notice does not constitute a waiver of its right to require strict compliance in the future.

9. General Information

Trope MC will pursue any breach of this Legal Notice, as well as any improper use of the Website, exercising all civil and criminal actions available to it under applicable law.

10. Notifications

Trope MC will make any communications it deems appropriate through the e-mail address provided by Users in the registration forms or through any other contact details provided by the User.

11. Copyright Infringement Notices (DMCA)

If you believe that content available on the Website or App infringes your copyright, you may send a notice of claimed infringement to Trope MC LLC at the mailing address above or by email to support@tropemc.org, in accordance with the notice-and-takedown procedure described in Trope MC’s Terms and Conditions.
