1.- Right to information.

We hereby inform you that this website https://tropemc.org/ (hereinafter, the “Website”) is the property of TROPE MC LLC (hereinafter, “TROPE MC”), with EIN number 32-0780450 and registered office at 1209 MOUNTAIN ROAD PL NE STE N ALBUQUERQUE, NEW MEXICO 87110, UNITED STATES.

Access to and/or use of the Website confers the status of user and accepts, from such access and/or use, the present Legal Notice.

2.-Website User

The User assumes responsibility for the use of the Website. The Website may provide access to a multitude of texts, graphics, drawings, designs, photographs, multimedia content and information (hereinafter, “Content”) belonging to TROPE MC or to third parties to which the User may have access.

The User must make appropriate use of the Contents and services offered through the Website and, by way of example, but without limitation, not to use them for:

  1. Engaging in activities that are illicit, illegal or contrary to good faith and public order.

  1. Causing damage to the physical and logical systems of the TROPE MC Website, its suppliers or third parties.

  1. Introduce or disseminate computer viruses or any other physical or logical systems that may cause the aforementioned damage.

  1. Attempting to access, use and/or manipulate the data of TROPE MC, third party collaborating entities and other users.

  1. Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the Contents, unless authorised by TROPE MC.

Delete, conceal or manipulate the Contents subject to intellectual or industrial property rights and other data identifying the said rights of TROPE MC or third parties included in the Contents, as well as the technical protection devices or any information mechanisms that may be inserted in the Contents.

TROPE MC shall have the right to investigate and report any of the aforementioned conducts in accordance with the Law, as well as to cooperate with the authorities in the investigation of such actions.

TROPE MC may temporarily suspend, without prior notice, access to the Website for maintenance, repair, updating or improvement operations. However, whenever circumstances permit, TROPE MC will inform the User, sufficiently in advance, of the planned date for the suspension of the services. TROPE MC is not responsible for the use that Users may make of the Contents included in the Website..

3.- Intellectual and industrial property.

Each and every one of the intellectual property rights over the content and graphic design of this Website (including, but not limited to, images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.) are the exclusive property of TROPE MC or of a third party that has authorised its use. Therefore, TROPE MC has the exclusive right to exploit such content and graphic design.

Therefore, pursuant to the provisions of Directive 2001/29/EC of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society, as well as Regulation (EU) 2017/1001 of 14 June 2017 on the European Union trademark, and other applicable European regulations on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution or public communication, including making available or any other form of commercial exploitation and/or modification of all or part of the content of the Website is expressly prohibited, unless prior and express authorisation has been given by TROPE MC.

TROPE MC does not grant any licence or authorisation to use any of its intellectual and industrial property rights or any other property or right related to the Website and/or the services or contents thereof.

The User undertakes to respect the Intellectual and Industrial Property rights owned by TROPE MC. In this regard, the reproduction and temporary storage of the contents of the Website is permitted insofar as this is strictly necessary for the use and visualisation of the Website from a computer/Tablet or personal telephone.

The legitimacy of the intellectual or industrial property rights over the content provided by Users is the exclusive responsibility of the Users themselves, who shall be liable for any claim by third parties arising from the unlawful use of the content of the Website.

The designs, logos, texts and/or graphics that do not belong to TROPE MC, and which may appear on the Website, belong to their respective owners, who are responsible for any possible controversy that may arise with respect to them.

5.- Liability and Guarantees.

TROPE MC declares that it has adopted all necessary measures, within its possibilities and taking into account the current state of technology, to allow the correct functioning and the absence of viruses and harmful components on its Website.

However, TROPE MC cannot guarantee:

  1. The continuity and availability of the Content and Services at all times;

  2. The existence of errors in such Content or the failure to correct any defects that may exist;

  3. The truthfulness, completeness or timeliness of the data provided by Users, with the User being ultimately responsible for providing accurate and up-to-date information;

This Legal Notice shall be in force indefinitely, and TROPE MC may make changes to the conditions specified herein, which shall take effect from the moment of their publication.

TROPE MC may remove, add or modify both the Content and the services it provides, as well as the way in which they are located or presented. The conditions published at the time the User accesses the TROPE MC Website are understood to be those in force.

Access to and/or use of the Website shall be understood as acceptance by the User of this Legal Notice and its conditions, including, where applicable, any amendments made thereto.

TROPE MC assumes no responsibility for links to other applications or websites found on the TROPE MC Website, which may direct the User to other applications or websites over which TROPE MC has no control.

In this sense, TROPE MC is not responsible for the information contained in these third party links or any effects that may result from such information.

Therefore, the inclusion of links to other websites or applications does not imply the approval of their contents by TROPE MC nor the existence of any kind of association between TROPE MC and the owners of other websites or applications.

Consequently, the User accesses under his sole responsibility to the Content and under the conditions of use that govern them.

8.- Safeguarding and interpretation.

This Legal Notice constitutes an agreement between each of the Users and TROPE MC.

If the competent authority declares a provision to be illegal, invalid or unenforceable, such a declaration in respect of one or more clauses shall be without prejudice to the validity of the other clauses.

The fact that TROPE MC does not require strict compliance with any of the provisions of this Legal Notice does not constitute or may in any way be construed as a waiver by TROPE MC of its right to require strict compliance in the future.

TROPE MC will pursue the breach of this Legal Notice, as well as any improper use of its website, exercising all civil and criminal actions that may correspond to it by law.
